RULES AND REGULATIONS

1. Florida Statue 719.303(3) & (4) – Unit Owner Fine or Suspension of Use of Rights. 

I. The association may levy reasonable for failure of a unit owner, its occupant, licensee, or invitee to comply with any provisions of the corporate documents or reasonable rule of the association. 

II. No fine will become a lien against unit. 

III. No fine with a single notice may exceed $100 per violation and such fine shall not in the aggregate exceed $1000. 

IV. An association may suspend for a reasonable period of time, the right of a unit owner, unit owners’ tenant, a guest, or invitee, to use the common elements, common facilities, or any other association property for failure to comply with any provision of the corporate documents or reasonable rules of the association. 

V. A fine or suspension may not be imposed except after giving at least 14 days written notice and an opportunity for a hearing to the unit owner and, if applicable, its occupant, licensee, or invitee. The hearing must be held before a committee of other unit owners who are neither board members nor persons residing in a board members household. 

VI. If the committee does not agree, the fine or suspension may not be imposed. 

2. No pets are permitted in the Park (Fairview Village). 

3. Repairing of automobiles, boats, motors, RV units shall be permitted ONLY in the designated area adjacent to Lot #1.

4. No storage of items of any description shall be permitted under RV units unless the unit is neatly skirted or enclosed.

5. Garbage cans, bags and recycle bins shall be concealed except when placed out on pickup days. Wheeled garbage totes are to be stored inconspicuously as possible at the side or rear of occupied residences/lots and concealed when unoccupied. Owners of vacant lots must make arrangements for the concealed storage of garbage totes/recycle bins when their lots are unoccupied.

6. This is an adult Park. Eighty (80) percent of occupied lots must contain one person age 55 years or older; this ratio is to be maintained by the Board of Directors by the approval or disapproval of REQUEST FOR TRANSFER OF PROPRIETARY LEASE FORM. Owners renting their lot must obtain prior approval from the Board of Directors if one of the tenants is not age 55 or older; this too, is to maintain the required eighty (80) percent ratio. Persons under twenty-one (21) years of age may visit for a two (2) week period from October 1 to May 31, and for an unlimited period from June 1 to September 30.

7. The rental of owner units and/or lots are limited to a maximum of six months during any calendar year. This restriction does not apply to an individual related to the owner by blood within the second degree. (Adopted at Owners Meeting 1/26/2002)

Please note: Bylaw Section 5:6A – In order to sublease his lot for a period in excess of three (3) months, a resident or special owner shall submit an application to the Board of Directors for approval of the sublease. The Board of Directors may approve the individual to whom the sublease is to be made and the term of the sublease is to be in accordance with the Bylaws.

8. Laundry facilities shall be available 7AM-10PM Monday through Saturday and from 11AM-10PM on Sunday. Dryers and a drying area are provided; therefore, clothes are not to be hung outside on any lot.

9. Bathrooms shall be open twenty-four (24) hours.

10. Fairview Village is classified by Polk County as a Mobile Home/RV Park. As such, all future owner units to be permanently constructed/installed within Fairview Village must be park model or manufactured homes. Recreational vehicles, 5th wheels, motor homes, etc., may not be permanently maintained within the park. This rule does not apply to existing permanently maintained units that are not park models or manufactured homes. However, when existing units are removed from the owner site, if they are to be replaced with another permanent unit, the replacement unit must be a park model or manufactured home.

10-1: Unoccupied RV’s, all classes of motor homes, towable 5th wheels and travel trailers of any type, may not be kept, left or stored on any owner’s lot in Fairview Village during the months of MayOctober. Utility trailers, boat and boat trailers, campers, and the like, may not be kept, left or stored on an owner’s lot. See Rule #29.

10-2: The maximum size of a storage or utility building on an owner’s lot is 9’ x 10’. All buildings must be installed at least five feet from any lot line. Sufficient open space must be maintained on the front or rear of the lot to park owner’s vehicle. Road parking is prohibited.

10-3: Prior approval of a Structural Change Request by a majority of the Board of Directors is
required BEFORE the installation of a new owner unit within Fairview Village and BEFORE structural changes are made to existing units. Additionally, Building Permits may be required from Polk County Building and Zoning Department BEFORE starting any such buildings and/or structural changes. 11. The speed limit within the Park (Fairview Village) is TEN (10) mph, care should be taken to watch for pedestrians and bike riders.

12. No soliciting or commercial enterprise shall be permitted in the Park (Fairview Village) without the prior written permission of a majority of the Board of Directors.


13. All lots are privately owned, therefore, no “cutting across” other lots. Use streets for walking or going from lot to lot.

14. Children shall not be permitted to use Fairview Village’s recreational facilities without adult
supervision.

15. Posted swimming pool regulations shall be observed. Chairs, chaise lounges, etc., shall be permitted within the fenced area of the pool. Smoking is prohibited within the fenced area of the pool. All glass containers are prohibited within the fenced area of the pool. No bathing suits shall be permitted in the Recreation Hall except in the poolside entrance to the restroom section. 16. No fences or structural changes shall be allowed without the written permission of a majority of the Board of Directors.

17. No nuisance will be allowed on the property, nor any use or practice which is the source of annoyance to residents or which interferes with the peaceful possession and proper use of the property by its residents. All parts of the property shall be kept in a clean and sanitary condition, with no rubbish, refuse or garbage allowed to accumulate, nor any fire hazard to exist. If the lot owner fails to keep the lot neat and clean from neglect or absence, the Board of Directors shall have the right to order entrance onto the property for the purpose of correcting such conditions, and any and all costs for such service will be charged to the lot owner.

18. Additional RV units may NOT be used for overnight accommodations when parked on an occupied lot.

19. Excessive noise, power mowing, etc., will not be allowed before 8:AM

20. All owners and renters will be responsible for the action of their visitors.

21. Watering restrictions for Polk County are printed daily in THE LEDGER. Please comply!

22. Lot #1 is to be used for travel trailers and motor homes for a period not to exceed fourteen (14) days on a first come first serve basis. The Park Manager or his designate shall manage the rental of Lot #1. Adopted at the Annual Owner Meeting on January 22, 2011.

23. Proprietary Lease Transfers and Structural Change Applications shall be approved by a majority of the Board of Directors and duly reported and recorded in the official park minutes for reference.

24. Standing Rules & Regulations may be amended by a majority vote of the Board of Directors at a duly called meeting and requires, two-thirds owner vote at the Annual Meeting before becoming official.

25. Roberts Rules of Order, Revised, shall govern all meetings of the Association not otherwise provided for in these Rules/Regulations and/or By-Laws.

26. Any registered Owner with two lots must reside in one.

27. Owners and Renters shall be responsible for the mowing of their lot(s) November 1-April 1 each winter season.

28. Two members of the same family cannot serve on the Board of Directors at the same time. Adopted at owners meeting 01/24/2012

29. Storage Area and Parking Trailers – This area is located in the south west corner of the park by lot#1. Please see the backside of this page for the trailer storage rule/procedure in its entirety as adopted at the 2019 Annual Leaseholders Meeting. See 29-1 thru 29-13.

29. Storage area and Parking Trailers – Adopted 2019 Annual Meeting
The following procedures for parking of trailers has become necessary to maintain a clean and neat appearance of our community, and to ensure fairness to all residents/owners (those with trailers and those who do not own trailers).

29-1: Fairview Village Storage Area Liability Waiver form must be completed, signed and returned with your payment to the Treasurer.

29-2: A monthly charge of $5.00 per axle will be collected for all trailers parked in the storage area at Fairview Village. Please see Treasurer for form and payment.

29-3: Trailer parking space it for Fairview Village residents and/or renters only. One trailer per owner and/or renter per lot. Owners are responsible for renters’ payment and adherence to the rules.

29-4: Parking spots will be assigned according to type and size of trailer (boat, enclosed etc.). Trailers are to be neatly parked with consideration for others.

29-5: Any trailer left in the storage area without an assigned site number will be subject to towing.

29-6: Trailers must be road-worthy, state registered and must be kept in good repair. The area
around/under your trailer is to be maintained and mowed.

29-7: Lot number or address must be placed on all trailers.

29-8: Contact owner (by lot number) if/when you need a trailer moved.

29-9: No hazardous substance is to be stored in or on any trailer.

29-10: Vehicle parking is short term parking only (less than 30 days).

29-11: Delinquent payments beyond 30 days will be subject to a fine of $100.00 for every day your payment is late.

29-12: NO parking North of utility pole.

29-13: Violations of the above procedures will result in removal of trailer/vehicle at the owners’ expense.
